Mail Plus Additional Terms of Service
1. THE SERVICE AND ACCEPTANCE OF TERMS
1.1 Welcome to the Yahoo! Mail Plus service (the ‘Mail Plus Service” or the "Service"), provided to you by Yahoo! Netherlands BV (“Yahoo”). Your use of the Service is subject to these Mail Plus Additional Terms of Service http://info.yahoo.com/legal/uk/yahoo/mail/plus.html (the "Mail Plus ATOS") which supplement the Yahoo! Terms of Service http://info.yahoo.com/legal/uk/yahoo/utos-173.html which Yahoo! Terms of Service are hereby incorporated by reference and which apply as between you and Yahoo! Netherlands BV. If you have upgraded to the new version of Yahoo! Mail, the “Global Communications Terms of Service” http://info.yahoo.com/legal/uk/yahoo/mail/atos.html will also apply as between you and Yahoo! Netherlands BV and are considered incorporated into this Mail Plus ATOS.
1.2 Yahoo! reserves the right to update and change, from time to time without individual notice to you, these Mail Plus ATOS and all documents incorporated by reference. You should periodically check for changes at the relevant URLs listed below. In the event of any inconsistency between these Mail Plus ATOS and any other relevant terms, these Mail Plus ATOS shall govern.

2. YAHOO! MAIL PLUS REGISTRATION OBLIGATIONS
2.1 In order to sign up for the Mail Plus Service you must have a Yahoo! ID and an existing free Yahoo! Mail account. To pay for the Mail Plus Service you will need to provide details of your payment instrument namely an accepted credit or debit card or an eligible online payment processing account (“Payment Instrument”). Yahoo! will store the details of your Payment Instrument and related billing information (“Billing Information”). You agree to provide accurate and complete Billing Information and to ensure that your Billing Information is kept up to date. If Yahoo! has reasonable grounds to suspect that you have provided any Billing Information that is inaccurate, not current or incomplete, Yahoo! may terminate your Mail Plus Account and refuse any current or future access to or use of the Mail Plus Service.
3. PAYMENT AND DELIVERY TERMS
3.1 The fee for the Mail Plus Service includes VAT if applicable. If VAT is not applicable, then the fee remains as stated. For example, if you are required to pay VAT, the price of £11.99 includes VAT. If you are not required to pay VAT, then the price is still £11.99. The price stated here is purely an example, please see this page for the current price.
3.2 Your Payment Instrument will automatically and immediately be charged the current fee for the Mail Plus Service you have selected on the date that you click on the "Place Order" Button. Your Payment Instrument will also automatically be charged the then-current fee for that Mail Plus Service at the commencement of each renewal year unless you cancel your subscription prior to the renewal date.
3.3 Once you click on the "Place Order" button, Yahoo! will provide the Mail Plus Service as soon as its system is updated, which can be instantaneous or at the most, within 48 hours.
3.4 If you cancel your subscription within 14 days of purchase, you will receive a full refund. If you cancel your subscription at any other time, you will not receive a refund and the Mail Plus Service will be provided to you for the remainder of your subscription period. For information on how to cancel your subscription, please contact Customer Care via www.billing.yahoo.com .
3.5 Yahoo! in its discretion may offer discounts or special offers from time to time. If you have received an offer for a free trial period for the Yahoo! Mail Plus Service then you will not be charged until after your free trial period has ended. Subsequent billing dates will be on the annual anniversary of your first billing date. For example, if you purchase a subscription on October 15th and you get a free trial period of 30 days and if you do not cancel within the first 30 days, then you will not be charged until November 14th. Thereafter, you will be automatically charged on November 14th of each subsequent year, until you decide to cancel when s3.4 above will apply.
3.6 To protect against potential fraud, Yahoo! may take steps to verify the validity of the credit or debit card information you provide to us. The verification process may include reserving a debit amount of between £0.01 and £1.00 from your credit or debit card account and then cancelling the reservation, as well as asking you to verify the amount debited in order to confirm that you are in possession of your credit or debit card. Yahoo! will only use this process to screen for fraud and will not otherwise debit your credit or debit card account except as part of a transaction conducted through your account for the Mail Plus Service. By providing Yahoo! with your credit or debit card information, you authorize Yahoo! to perform the above mentioned debit and credit reservations on your credit or debit card account as described above.
4. TERM AND TERMINATION
4.1 The Mail Plus Service is provided to you for 12 months and will automatically renew at the end of each 12 month subscription period unless you cancel the Mail Plus Service before your renewal date. Yahoo! will send you an email reminder prior to the end of each subscription period. If you cancel the Mail Plus Service within 14 days of activation, you will receive a refund. If you cancel the Mail Plus Service anytime after 14 days, you will not receive a refund and the Mail Plus Service will be provided to you to the end of the 12 month period.
4.2 Yahoo! may, in its discretion, immediately terminate the Mail Plus Service if Yahoo! believes that you have violated or acted inconsistently with the letter or spirit of the Mail Plus ATOS or any documents incorporated therein. Termination of the Mail Plus Service may result in the deactivation of your Yahoo! Mail account and deletion of all related information, files and Content. If your Payment Instrument is invalid for any reason or Yahoo does not receive payment for the Mail Plus Service, your Mail Plus Service and all associate premium features will be discontinued, your Mail Plus Account will be downgraded to a free Yahoo! mailbox and your account will be transferred to the relevant Yahoo! group company providing that free account. You agree that Yahoo! shall not be liable to you or any third-party for any termination of your access to the Service.
6 GENERAL INFORMATION
Entire Agreement: These Mail Plus ATOS (and all terms incorporated therein) constitute the entire agreement between you and Yahoo! regarding your use of the Mail Plus Service, superseding any prior agreements between you and Yahoo! with respect to the Service. By way of a reminder, your Mail Plus Service will continue to be governed by these Mail Plus ATOS unless and until you agree to other terms of service that specifically identify those terms and those services (by name) as being superseded. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software.
Governing Law: These Mail Plus ATOS and the relationship between you and Yahoo! with respect to the Service and any related non-contractual obligations shall be governed by the laws of England. You and Yahoo! agree to submit to the exclusive jurisdiction of the English courts to settle any dispute in relation to these Mail Plus ATOS and any non-contractual obligations relating to them. As a result of these Mail Plus ATOS being governed by English law, your Billing Information and Content (as defined above) may be subject to, for example the disclosure laws and the authority of public safety bodies in the UK. Additionally, your Mail Plus Service is provided by Dutch entity which may also be subject to Dutch laws.
