ACCEPTANCE OF TERMS OF SERVICE AND THESE ADDITIONAL TERMS
Welcome to Yahoo! Classifieds Express. Yahoo! provides its Yahoo! Classifieds Express service to you subject to the Terms of Service ("TOS") at http://info.yahoo.com/legal/us/yahoo/utos/utos-173.html and these Additional Terms ("Additional Terms"), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time at the URL link specified above. Please read the TOS and these Additional Terms before using Yahoo! Classifieds Express. Your use of the Yahoo! Classifieds Express service constitutes your agreement to all terms and conditions contained the TOS and these Additional Terms.
POSITIONING
The placement and positioning of any Classified Listings submitted or published through or posted to Yahoo! Classifieds Express (each a "Classified Listing") is at the sole discretion of Yahoo!. In addition to those disclaimers contained in the TOS, you acknowledge that Yahoo! has made no representation or warranty of any kind with respect the placement, positioning or usage of any Classified Listings. Yahoo! shall have no liability of any kind for any claims whatsoever, including, without limitation, for any failure to post any Classified Listing, or any error or omission in the placement or positioning of any Classified Listing.
REPRESENTATIONS; INDEMNIFICATION
Classified Listings are accepted on the representation that you have the right to permit Yahoo! to publish and distribute the Classified Listings without infringement of any rights of any third party. You agree not to upload, post, or otherwise provide any Classified Listing that violates the rights of any third party or is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that is harmful to minors in any way.
In addition to those indemnification obligations specified in the TOS, you agree to indemnify and hold Yahoo! harmless against any and all claims, damages, expenses and losses of any kind (including reasonable attorneys' fees and costs) as and when incurred by Yahoo! in connection with any claims of any kind relating to the Classified Listings, including without limitation any claim of damage to life or property, product liability, copyright or trademark infringement, libel, defamation, invasion of privacy or breach of confidentiality, arising out of the publication of the Classified Listings and/or any materials to which users can link through the Classified Listings, or products or services obtained or available through the Classified Listings.
PROVISION OF MATERIALS
You shall provide all materials for the Classified Listings (including, without limitation, JPEG, GIF, virtual tours and video and sound files), in accordance with Yahoo!'s policies in effect from time to time, including, without limitation, those contained in the Yahoo! Classified Express Guidelines and Policies at Guidelines and Policies
RIGHT TO REJECT CLASSIFIED LISTINGS
Yahoo! reserves the rights to reject, modify, cancel or move any Classified Listing, in whole or in part, at any time, including any URL link contained therein.
NO PUBLIC ANNOUNCEMENTS
You agree that any and all press releases and other public announcements related to your participation in the Yahoo! Classifieds Express service, including the method and timing of such announcements, must be approved in advance by Yahoo! in writing. Yahoo! reserves the right to withhold approval of any public announcement in its sole discretion. Without limiting what constitutes a material breach under the TOS or these Additional Terms, any violation of this Section 6 shall be deemed a material breach of the TOS and these Additional Terms.
