The following list is a group of guidelines and additional terms of service for the Yahoo! Mail service:
1. ACCEPTANCE OF TERMS
Welcome to POP Access and Mail Forwarding! Your use of this service is subject to these additional terms that supplement the Yahoo! Terms of Service (http://info.yahoo.com/legal/us/yahoo/utos/utos-173.html), incorporated by reference.
Yahoo! reserves the right to update and change, from time to time, these additional terms and all documents incorporated by reference. You can always find the most recent version of these additional terms at http://info.yahoo.com/legal/us/yahoo/mail/popaccesstos/popaccesstos-299.html and the most recent version of the Yahoo! Terms of Service at the URLs indicated above.
2. CERTAIN REQUIREMENT FOR POP ACCESS AND MAIL FORWARDING
Please note, you should check with your ISP to ensure that POP Access will work for you. Some ISPs do not allow their users to send messages with other SMTP servers. If your ISP does not allow access to the Yahoo! SMTP servers, you will not be able to use a POP3 client to send e-mail through the Yahoo! servers (see http://help.yahoo.com/help/us/mail/context/context-45.html).
Also please check to make sure your email client supports authenticated SMTP. If you use a program that does not support the authenticated SMTP protocol, you will not be able to send mail using the Yahoo! SMTP servers. The most recent versions of popular clients (Outlook, Outlook Express, and Eudora) do support authenticated SMTP (see http://help.yahoo.com/help/us/mail/pop/pop-11.html).
3. CONDUCT AND OBLIGATIONS
The Yahoo! Terms of Service, which apply to your use of POP Access and Mail Forwarding, provides that Yahoo! may establish limits on the maximum number of email messages that may be sent from or received by your Yahoo! Mail account and the maximum size of any email message that may be sent from or received by your account. These limitations also apply to your use of POP Access and Mail Forwarding.
When using Mail Forwarding, you must own the email address that you are forwarding email too.
You acknowledge that Yahoo! has the right to suspend or terminate your account and refuse current or future use of any Yahoo! service with or without warning if Yahoo! believes you have violated or attempted to violate the rights of others, or have acted inconsistently with the spirit or letter of the Yahoo! Terms of Service, or these additional terms. Please note, you will not be entitled to receive a refund if Yahoo! cancels your service for the reasons indicated above.
4. YAHOO! ID AND YAHOO! WALLET REQUIREMENT
To subscribe and use POP Access and Mail Forwarding, you must have a Yahoo! ID, Yahoo! Mail account, and a Yahoo! Wallet. If you do not have a Yahoo! ID or Yahoo! Wallet, you will be prompted to complete the applicable registration process. (see http://wallet.yahoo.com/)
5. PAYMENT TERMS
The credit card that you provided in conjunction with Yahoo! Wallet will automatically be billed for the then-current amount of the POP Access and Mail Forwarding service specified on the order page and will be automatically billed upon the renewal of your service. All currency references are in U.S. dollars. Please note, unless Yahoo! provides express notice otherwise, payment for the POP Access and Mail Forwarding is non-refundable.
6. CANCELLATION AND TERMINATION
If your credit card is invalid for any reason, charged back, or if Yahoo! does not receive payment, your POP Access and Mail Forwarding will be cancelled immediately. If you choose to cancel POP Access and Mail Forwarding, your cancellation will take effect at the end of the billing cycle in which you cancelled. At the end of your billing cycle, your POP access will be terminated, and your Yahoo! Mail messages will stop being forwarded.
7. SERVICE PROVIDED "AS-IS"
The Yahoo! Terms of Service, which apply to your use of POP Access and Mail Forwarding, provides that Yahoo! services, which includes POP Access and Mail Forwarding, is provided on an "as-is" and "as available" basis. You will not be entitled to receive a refund for any problems, technical or otherwise, beyond Yahoo!'s reasonable control.
8. INVALIDITY OF SPECIFIC TERMS
If any provision of these additional terms or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the such documents remain in full force and effect.
9. LOCATION OF LAWSUIT
The Yahoo! Terms of Service, which apply to your use of POP Access and Mail Forwarding, provides that both you and Yahoo! agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California.
