1. ACKNOWLEDGMENT AND ACCEPTANCE OF YAHOO! MAIL PLUS TERMS OF SERVICE

Welcome to the Yahoo Mail Plus service (the "Service"), owned and operated by Yahoo! Inc. ("Yahoo"), a service through which registered Yahoo Mail users can pay for a combination of extra storage in their Yahoo mailbox, email forwarding, POP access, and other features.

The Service is provided to you under the terms and conditions of the Yahoo Mail Plus Terms of Service, and the Yahoo Terms of Service (https://info.yahoo.com/legal/us/yahoo/utos/utos-173.html) (all together the "Agreement").

For clarity, Yahoo Mail Plus is a "Service" as defined in the Yahoo Terms of Service. Yahoo can update and change the Agreement from time to time without notice to you. During the term of the Agreement, you can find the most recent version of the Yahoo Mail Plus Terms of Service at https://info.yahoo.com/legal/us/yahoo/mail/mailplustos/mailplustos-297.html and the most recent versions of the Yahoo Terms of Service at the URLs listed above.

BY CLICKING ON THE "I ACCEPT" BUTTON, YOU AGREE TO BE BOUND BY THIS AGREEMENT, SO PLEASE READ THE TERMS AND CONDITIONS CAREFULLY.

2. YAHOO! MAIL PLUS REGISTRATION

In order to sign up for the Service, you must have an existing Yahoo ID. You must also provide your credit card and billing information, which will be stored by Yahoo. You agree (a) that the credit card number and other information you provide is valid, accurate, current, and complete and (b) to maintain and promptly update that information to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Yahoo has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Yahoo has the right to terminate your account and refuse any and all current or future access to or use of the Service.

3. PAYMENT TERMS

Your credit card will automatically be charged the current fee for the Service you choose on the date that you click on the "Purchase Order" button in the ordering process. Your credit card on file will also automatically be charged the then-current fee for that Service at the commencement of each renewal year. Fees may not be credited towards other services. Current fees will be posted at Yahoo Mail in the Options section. Please note, unless Yahoo provides express notice otherwise, payment for the Service is non-refundable.

4. COMMUNICATIONS

As part of the Service, you agree to receive the first of an ongoing series of product update communications related to the Service ("Mail Plus Update"). Upon receipt of this first Mail Plus Update, you will have the opportunity to opt-out of future Mail Plus Updates by clicking on unsubscribe links or by following unsubscribe instructions within the communication. Please note that you may also visit your Yahoo Marketing Preferences page at any time to manage your communication preferences for other optional communication categories.

5. TERM AND TERMINATION

5.1 The Service is provided on a year-to-year basis commencing on the date that you sign up for the Service. The Service will automatically be renewed on the anniversary of that sign-up date each year and the Service will be automatically renewed at the then-current fee. Yahoo will send you an email reminder notice prior to the end of the term. If you choose to cancel the Service, your cancellation will take effect immediately and your Yahoo mailbox will revert to a free Yahoo mailbox – including the storage size limitations and features of a free Yahoo mailbox. You will receive a partial refund based on the number of days between the anniversary date of your sign up for the Service and your cancellation date. Please note that when your Yahoo mailbox storage size reverts to the free Yahoo mailbox size, new emails will not be delivered to you until you have reduced your Yahoo mailbox to the then-current storage size of a free Yahoo mailbox.

Please note: Yahoo in its discretion may offer discounts or special offers from time to time. If you have received an offer for a free trial period in connection with signing up for a Service, then you will not be charged for the first time until after your free trial period has ended. Subsequent billing dates will be on the annual anniversary of your first billing date. For example, if you purchase a subscription on October 15th and you get the first 30 days free and if you do not cancel within the first 30 days, then you will not be charged at all until November 14th (there are 31 days in October). Thereafter, you will be automatically charged again on November 14th of each subsequent year, until you decide to cancel.

5.2 Yahoo may, but has no duty to, immediately terminate the Service if Yahoo in its sole discretion if it concludes that you have provided false information in connection with your account or billing information, are engaged in fraudulent or illegal activities, or are engaged in activities that may damage the rights of Yahoo or others.

5.3 In addition, Yahoo may immediately terminate the Service if you fail to abide by the terms of this Agreement. Termination of the Service may result in the deactivation or deletion of your Yahoo Mail account and the forfeiture and relinquishment of all files you have accrued in your Yahoo mailbox. If your credit card is invalid for any reason or Yahoo does not receive payment for the Service, your Service will be downgraded to the then-current storage size of a free Yahoo mailbox.

6. ADDITIONAL SOFTWARE

If you elect to download any elective, additional Software (as defined in the Yahoo Terms of Service) made available by Yahoo in connection with the Service, you agree that such Software is subject to the Yahoo Terms of Service. You further agree that you may have to agree to additional terms and conditions before you use such Software.

7. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" BASIS. YAHOO! EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

YAHOO! MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, INCLUDING BUT NOT LIMITED TO THE PERFORMANCE OF ANY ANTI-SPAM RELATED TECHNOLOGY, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

8. RESERVATION OF RIGHTS

Yahoo Mail Plus and its benefits are offered at the discretion of Yahoo, and Yahoo has the right to modify or discontinue, temporarily or permanently, the Service, in whole or in part for any reason, at its sole discretion, with or without notice to you. You agree that Yahoo will not be liable to you or any third-party for any modification or discontinuance of the Service.

9. INVALIDITY OF SPECIFIC TERMS

If any provision of these terms or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of such documents remain in full force and effect.

10. LOCATION OF LAWSUIT

The Terms of Service, which apply to your use of the Services, provide that both you and Yahoo agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, USA. The Yahoo Terms of Service, these Terms of Service and the relationship between you and Yahoo shall be governed by the laws of the State of California without regard to its conflict of law provisions.
